These Terms of Service ("Terms") govern your use of the website located at www.truenorthadventures.com (the "Site") and the services offered by True North Adventures ("we," "our," or "us").

By accessing or using the Site, booking a tour, or utilizing our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Site or use our services.

Use of the Site

Eligibility

You must be at least 18 years old to use our Site and services. By using our Site and services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

Account Creation

Some features of our Site may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Prohibited Conduct

You agree not to:

Use the Site in any way that violates any applicable federal, provincial, local, or international law or regulation
Use the Site to transmit or send unsolicited commercial communications
Use the Site to impersonate or attempt to impersonate True North Adventures, our employees, another user, or any other person or entity
Interfere with or disrupt the Site or servers or networks connected to the Site
Attempt to gain unauthorized access to parts of the Site, other accounts, or computer systems or networks connected to the Site
Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site
Introduce any viruses, Trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful
Use the Site in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Site

Booking and Payments

Booking Confirmation

Your booking is not confirmed until you receive a written confirmation from us. We reserve the right to refuse service to anyone at our discretion.

Payment Terms

Payment terms vary by tour and are specified during the booking process. Generally, a deposit is required at the time of booking, with the balance due a specified number of days before the tour start date. All payments are processed in Canadian dollars (CAD).

Pricing and Taxes

All prices displayed on our Site are in Canadian dollars and include applicable taxes unless otherwise stated. We reserve the right to modify our prices at any time. Price changes will not affect bookings that have already been confirmed.

Cancellations and Refunds

Cancellation by You

Our cancellation policy varies depending on the tour and is specified during the booking process. In general:

Cancellations made 60 or more days prior to the tour start date: Full refund minus a $100 administrative fee
Cancellations made 30-59 days prior to the tour start date: 50% refund
Cancellations made less than 30 days prior to the tour start date: No refund

All cancellation requests must be made in writing to info@tyoplaya-zeleni.com.

Cancellation by Us

We reserve the right to cancel a tour for any reason, including insufficient participation or force majeure events. In case of cancellation by us, you will receive a full refund of all payments made to True North Adventures. However, we are not responsible for any additional expenses incurred by you in preparation for the trip (e.g., non-refundable airline tickets, visa fees, equipment, etc.).

Changes to Bookings

Requests for changes to bookings must be made in writing to info@tyoplaya-zeleni.com. We will make reasonable efforts to accommodate your request, but cannot guarantee that changes will be possible. A fee may apply to booking changes.

Travel Requirements

Travel Documents

You are responsible for obtaining all necessary travel documents, including valid passports, visas, and any required vaccinations. True North Adventures is not liable for any losses incurred due to your failure to have the proper documentation.

Health and Fitness

Our tours involve varying levels of physical activity. You must ensure that you are in sufficient health and fitness to participate in your chosen tour. You must disclose any medical conditions or physical limitations during the booking process.

Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance that includes coverage for trip cancellation, medical emergencies, and baggage loss or delay. True North Adventures is not responsible for any losses that may be covered by travel insurance.

Intellectual Property

Site Content

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by True North Adventures, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our express written consent.

Trademarks

The True North Adventures name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of True North Adventures or its affiliates or licensors. You may not use such marks without our prior written permission.

User-Generated Content

Submission of Content

Certain features of the Site may allow you to submit comments, reviews, or other content. Any content you post to the Site will be considered non-confidential and non-proprietary.

Content Standards

You agree that any content you submit to the Site will not:

Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable
Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person
Violate the legal rights of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations
Be likely to deceive any person
Impersonate any person, or misrepresent your identity or affiliation with any person or organization
Promote any illegal activity, or advocate, promote, or assist any unlawful act

Monitoring and Enforcement

We have the right to:

Remove or refuse to post any user content for any or no reason
Take any action with respect to any user content that we deem necessary or appropriate in our sole discretion
Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights
Terminate or suspend your access to all or part of the Site for any or no reason

Limitation of Liability

In no event will True North Adventures, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site, any websites linked to it, any content on the Site or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages.

Indemnification

You agree to defend, indemnify, and hold harmless True North Adventures, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of the Province of British Columbia, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.

Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
